Kathleens Public Comments to BHEC Council
I’m a survivor of the DSHS era regime’s good ol’ boy complaint process. That faith-killing experience has given me a very rich, real world backdrop against which I can confidently evaluate the progress BHEC has made over the last six years. You have put this profession back on the administrative rails it has lacked for so long and I thank you for that, but we face a much larger problem now. Our profession has been under attack since at least 2000 for its very soul and I would like to expand on two comments Phillip made earlier.
What Are We Doing to Raise the Bar of Competency?
He mentioned that the bar of competency needs to be raised and that "we are working on that". To that end…
#1. We're endorsing additional legislation to bolster punitive options for infractions of SB's 12 & 14. One of our members, Rebecca Smith, is heading this effort and will be re-submitting a bill that, given the passing of SB14 should gain more traction this session.
#2. While legacy professional org's and independent ce providers work together to educate their constituents on how to circumvent the law, and awarding ce credit for doing so, we're working to inform our membership on how the higher education system is currently being cleansed of DEI and social justice through EO 12479.
There Is a Lot BHEC Can Do About Enforcement
Phillip also stated that "there is a lot that BHEC, the Boards and the Council, can do about enforcement" of SB's 12 and 14 and the various Opinions and BHEC statements that have been made and are being ignored. Three things we’d like to see happen:
#1. Make it clear to all licensees through the appropriate entries in the rulebooks and penalty matrices exactly what the outcomes will be for violating SB's 12 & 14 and be specific!
#2. Repeatedly distribute a statement that the BHEC Rulebook is the official code of ethics in TX. If secondary ethics documents one chooses to follow promote activities that are illegal in TX you may lose your license.
#3. Then, issue repeated public statements on behalf of the Boards, Council, and BHEC Agency that any professional organization, coalition, ce provider, or licensed individual who openly promotes illegal activities to BHEC licensees runs the very real risk of punitive action as outlined in State code including a potential loss of license as each case warrants.
#4. Make it very clear to all licensed ce providers that any training provided with the obvious intent to circumvent state law to continue illegal activities under the table will result in a highly probable loss of license and likely civil action through the TX AG's office. Not asking you to police ce courses other than those that may come to your attention through the complaint process. Licensees are awarding CE credit for training designed to circumvent the law, in the name of social justice. I'd like to know if BHEC is going to accept these CE's for renewal purposes??
#5. Board members should resign their membership in any/all professional organizations still promoting outlawed illegal activities or actively countering or circumventing any state entities' official positions on settled law. You can't serve two masters.
#6. Licensees and legacy professional organizations spend much time online encouraging each other to ignore statements from BHEC, the AG, and the State. This negatively impacts the public. This is not a free speech issue, it's a violation of a contract they signed with the State for their license and there must be repercussions for it.
What I'd Like BHEC to Do
Our accrediting institutions, grad programs, and legacy organizations have surrendered to an ideology and we don’t have another twenty years to wait and hope things turn out ok. That is why we started AMHP, so conservative, God-fearing, wholistic therapists have a place to go for healing and direction without feeling like they’ve been attacked by colleagues. I’m inviting you to buy a ticket and attend our event so you can see what else is out there, what mental health counselors should be talking about.
Protecting Joe Citizen may include some distasteful activities but that's where we find ourselves. I encourage you to discuss these things privately, then openly, as soon as possible and take whatever actions are necessary to proactively uphold the law and protect our clients.
